Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the MarathonFinder mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

2. Service Description

MarathonFinder provides the following services:

• GPS-based marathon and race discovery (real-time location only)
• Distance-based race filtering (5K, 10K, Half Marathon, Full Marathon, Ultra)
• Running club creation and management
• Club member participation tracking
• Marathon event information display

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time without notice.

3. Eligibility

To use MarathonFinder, you must:

• Be at least 13 years of age (This app is rated for ages 13+)
• Have the legal capacity to enter into these Terms
• Not be prohibited from using the App under applicable laws
• Provide accurate registration information via Google or Apple Sign-In
• Be located in the United States or Canada (primary service areas)

4. User Accounts

Account Creation

• Accounts are created through Google or Apple Sign-In only
• You must use your real identity (as provided by Google/Apple)
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use
• We do not store passwords - authentication is handled by Google/Apple

Account Termination

We reserve the right to suspend or terminate accounts that:

• Violate these Terms
• Provide false information
• Engage in fraudulent or illegal activities
• Remain inactive for extended periods

5. User Conduct

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Harass, abuse, or harm other users
• Post false, misleading, or inappropriate content
• Impersonate any person or entity
• Interfere with or disrupt the App's operation
• Attempt to gain unauthorized access to any portion of the App
• Use automated systems or software to extract data
• Transmit viruses or malicious code
• Engage in any activity that could damage our reputation

6. User Content

Content Ownership

You retain ownership of content you post to MarathonFinder. However, by posting content, you grant us a worldwide, non-exclusive, royalty-free license to:

• Use, reproduce, and display your content in connection with the App
• Modify or adapt your content for technical requirements
• Share your content with other users as part of the service

Content Responsibility

You are solely responsible for your content and the consequences of posting it. We do not endorse user content and are not liable for any content posted by users.

7. Intellectual Property

The App and its original content (excluding user content), features, and functionality are owned by MarathonFinder, Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Third-Party Content

Marathon information, race logos, and event details are the property of their respective organizers. We display this information for informational purposes only.

8. Privacy and Data

Your use of the App is also governed by our Privacy Policy. Key points:

• We use social login (Google/Apple) - no password storage
• GPS location is used real-time only, never stored
• Club locations are stored for discovery features
• We don't sell your data or send marketing emails

Marathon Information Disclaimer

Health and Safety Disclaimer

Location Services

Our GPS-based search uses your location only when you explicitly request it. We do not track or store your location history. Club locations are stored to enable local discovery features.

No Payment Processing

MarathonFinder does not process any payments or race registrations. All race registrations must be completed through official race websites.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARATHONFINDER, INC. SHALL NOT BE LIABLE FOR:

• Any injuries or health issues arising from running activities
• Inaccurate marathon information or changed event details
• Missed races due to incorrect information
• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or goodwill

Since MarathonFinder is a free service, our total liability shall not exceed $100 USD.

11. Indemnification

You agree to indemnify, defend, and hold harmless MarathonFinder, Inc., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:

• Your access to or use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your user content

12. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via the App or email. Your continued use of the App after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with:

• For U.S. users: Laws of the State of California, United States
• For Canadian users: Laws of the Province of Ontario, Canada

Dispute Resolution

We encourage users to contact us first to resolve any disputes. If necessary, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Service Area

MarathonFinder is designed specifically for users in the United States and Canada. Race information focuses on North American events.
